Amending the bylaws
Before you vote to amend the bylaws, you should consider why the HOA board is asking for this change. The board hasn’t made this clear at all. They just talk through Margo, and passively say “The HOA’s attorneys have recommended updates to our bylaws”. Why isn’t the board explaining what they’re doing in clear language?
The board has expanded to 5 people, and that is against the bylaws. They should have held a vote, and they didn’t. Where was the attorney when they did this? The current board structure is fundamentally against the bylaws. This is messy, and they don’t know what to do about it. They’ve been operating illegally.
Why do condo owners need to be able to vote by proxy? Does this have anything to do with board members not needing to reside in Potomac Yard? It turns out there is a history of HOA board members not living within Potomac Yards. That doesn’t look good for the board.
Why is the HOA saying this is at the recommendation of the attorneys? Where does the board stand on these issues? Why does the atty care if some members can vote by proxy, when we can all vote electronically? They should be explaining why they want to make changes, and it should make sense.
