First Service Residential

Firstly, 89 pages is ridiculous. 

More importantly, First Service Residential is specifically named in the rules and regulations for the HOA. Evidently the HOA's board is so vendor locked to Margo that they've written into the rules full time staffing support from FSR:

"The affairs of Potomac Yard HOA (“Association”) are overseen by a Board of Directors consisting of five elected homeowners, who meet in an open forum on a quarterly basis to discuss Association business. The Association’s daily operations are managed by FirstService Residential."

The HOA recently appointed their own board member to replace a removed board member. This is a clear violation of the Rules and Regulations as quoted above. Never mind that this rule that the daily operations be managed by FSR is a direct impediment to changing out the management agency for the HOA.

Per the rules page 5 paragraph t, by definition, FirstService Residential is the property manager for the Association. Any change to the property manager would require a rule change prior to changing out the property manager.

Also, per the rules page 5 paragraph u, the Community Association Manager is an employee of FSR, but the Manager's salary is covered by the Association's budget. This is in the rules. There can be no Community Manager without FirstService Residential hiring someone that the Association pays for, yet the association has no ability to choose the person or remove the person for failure to perform.

We have vendor lock to a terrible vendor, and the HOA Board of Directors loves this because FSR can harass homeowners, and the Board of Directors can sit by and plead ignorance. We are wasting money on an inept Community Manager, and there is no price to pay for this.
